In consideration and as an inducement of participating in service, coaching, instruction, and modalities provided by Sparky Spirit and Sparks, The Pocket Astrologer, ("Sparks," "Service," "we," "us," or "our") the User agrees to the following:

If you do not agree to these Terms, you must immediately cease using the Service.

1. Nature of the Service & Entertainment Disclaimer

Sparks is strictly for entertainment, self-reflection, and educational purposes only.

• Not Professional Advice: The astrological insights, chart calculations, lunar guidance, and coaching prompts provided by Sparks do not constitute and should never replace professional medical, psychological, psychiatric, financial, legal, or business advice.

• No Life Decisions: You are solely responsible for your own life choices. Sparks and its creator are not responsible or liable for any actions, decisions, or consequences (direct or indirect) resulting from your interaction with the Service.

• Mental Health: If you are experiencing a mental health crisis, severe psychological distress, or require medical attention, you must immediately stop using the Service and contact a qualified healthcare professional or emergency services.
   

2. Artificial Intelligence Acknowledgment

Sparks is an automated conversational agent powered by Large Language Models (LLMs) and third-party astronomical calculation APIs. By using the Service, you acknowledge and agree that:

• AI Limitations: While Sparks is programmed with strict astrological rules, AI can hallucinate, produce factual errors, or generate repetitive or contradictory statements.

• No Human Astrologer: You are interacting with a machine learning algorithm, not a live human astrologer.

• No Guaranteed Accuracy: We make no warranties regarding the absolute accuracy, completeness, or reliability of the astrological data, chart calculations, or generated text.
   

3. Data Collection & Privacy

To function, Sparks must collect, store, and process specific personal data. By using the Service, you consent to the following data flows:

• Data We Store: We store your Telegram User ID, your exact birth details (date, time, location), your current timezone, and your chat logs on our secure servers.

• Third-Party API Processing: To generate readings, your data is securely transmitted to third-party providers (FreeAstroAPI and Google Gemini).

• Data Privacy on Paid Tiers: We utilize enterprise/paid tiers of our AI providers, which means your personal chat logs and birth data are explicitly excluded from being used to train future public AI models.

• Partner Data (Synastry): If you input the birth data of a partner or third party, you explicitly represent and warrant that you have obtained their direct consent to use and store their personal data within the Service.
   

4. Subscriptions, Payments & Cancellations

Sparks operates on a freemium model, offering a limited number of free messages before requiring a paid subscription.

• Payment Processing: All subscription payments (e.g., $20/month) are processed securely by Stripe. We do not collect, store, or have access to your full credit card number or bank details.

• Automatic Renewal: Paid subscriptions bill automatically on a recurring monthly basis until canceled.

• Cancellations: You may cancel your subscription at any time via the Stripe customer portal link provided in the bot or upon request. Upon cancellation, you will retain access to the Service through the end of your current paid billing cycle.
   

5. STRICT NO-REFUND POLICY

Due to the immediate, digital, and resource-intensive nature of this Service, all sales are final and non-refundable under any circumstances.

• Immediate Consumption: When you send a message to Sparks, the Service instantly purchases server processing power and AI generation tokens on your behalf. Because these digital resources are consumed immediately and cannot be returned or recovered by us, we cannot offer refunds for messages generated or time used.

• No Prorated Refunds: We do not provide credits, refunds, or prorated billing for mid-month cancellations or for months where the Service was unused.

• Responsibility to Cancel: It is your sole responsibility to manage your subscription and cancel prior to your next renewal date if you no longer wish to be billed.
   

6. User Conduct & Acceptable Use

You agree to use Sparks respectfully and lawfully. You are strictly prohibited from:

• Using the Service if you are under the age of 18.

• Inputting sensitive personal information (such as Social Security Numbers, banking details, or home addresses) into the chat.

• Attempting to reverse-engineer, scrape, hack, or exploit the bot’s source code, prompts, or API connections.

• Submitting abusive, threatening, or illegal content into the chat.

• Note: We reserve the right to ban, block, or terminate the access of any user who violates these Terms, without notice or refund.
   

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the creator of Sparks, its affiliates, or third-party service providers be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Service.

8. Changes to the Terms or Service

We reserve the right to modify, suspend, or discontinue any aspect of the Service (including pricing) at any time. We may update these Terms periodically. Continued use of the Service after any such changes constitutes your consent to the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of [Insert Your State/Country], without regard to its conflict of law principles.
